HOUSE VA COMMITTEE ACTIONS From the NAUS Weekly Update May 2, 2008 - The full House Veterans' Affairs Committee met on Wednesday and approved a slate of fourteen veterans' benefit and health care bills.  One of the bills provides for an annual cost of living increase in veterans' disability benefits and Dependency Indemnity Compensation.  Another bill, H.R. 5684, would significantly increase educational benefits for veterans.  Two amendments were added to this bill.  Ranking Member Rep. Steve Buyer (R-IN) added an amendment that would allow reserve members to count their active duty time cumulatively, rather than consecutively, as is currently required.  Rep. Mike Michaud (D-ME) successfully added an amendment that would allow veterans to use the GI Bill to obtain a commercial drivers license.

TRICARE FRAUD From the NAUS Weekly Update May 2, 2008 - Last week a federal judge directed a Philippine company to pay back nearly $100 million it swindled from TRICARE.  The company, Health Visions Corporation, pled guilty to mail fraud last year.  It was ordered to liquidate all assets, pay $99,915,131 in restitution, pay a $500,000 fine, and forfeit a swindled $910,910.60.  In addition, the corporation, its officers, directors and employees have been barred from any future participation in TRICARE or other government programs. Health Visions' ran its racket over a period of about seven years between Oct. 1, 1998, and August 2004.  During that timeframe, its doctors, hospitals and clinics, oftentimes with the assistance or knowledge of military retirees, inflated claims and billed TRICARE for services that were never provided.  But the extent of the fraud went beyond Health Visions.  In 2003 alone, two-thirds of the amount paid to Philippine providers, roughly $40 million of $61.8 million, is believed to have been fraudulent.  17 individuals have already been convicted for their participation in various schemes and many other cases are pending. According to a recent press release, TRICARE Management Activity claims processing requirements and controls in the Philippines have been revised to reduce fraud.  However, a February 2008 DoD audit reported that the program remains vulnerable to rip-offs and makes a series of proposal to strengthen internal controls even further. DoD has been rightfully criticized for being slow to act to identify and curtail this illegal action and the lack of financial oversight by the people who are supposed to be "minding the store."  All of this comes at a time when the department is asking Congress to raise fees for military retirees and their beneficiaries.  Clearly DoD needs to pursue effective and appropriate ways to make TRICARE more cost-efficient before seeking to "tax" beneficiaries.  That includes getting off its hands to get a grasp on fraudulent behavior.

SBP ACCOUNTS BEING REVIEWED From the NAUS Weekly Update May 2, 2008 - The Defense Finance and Accounting Service is currently reviewing all military retiree accounts affected by the new "Paid-Up SBP" law.  On Oct. 1, retirees who are at least 70 years old and have paid at least 30 years of premiums will no longer have to pay premiums to keep the coverage.  The change will be reflected in the Nov. 2008 pay statement.  If a retiree does not meet the eligibility criteria on Oct. 1, the premiums will stop when the retiree has met both criteria - reached age 70 and paid SBP premiums for 30 years.  Eligible retirees will be notified by DFAS via mail regarding the status of their account and premium payment count.

VETERAN POPULATION PROJECTION UPDATED From the NAUS Weekly Update May 2, 2008 - VA Press Release - The Department of Veterans Affairs has updated the official estimate of the veteran population.  Using its Veteran Population Model (VetPop), VA estimates a total veteran population of approximately 24,816,000 as of September 30, 2007.  Estimates are based on data from the Department of Defense (DoD), the Census Bureau and the Veterans Benefits Administration.  VetPop was last updated in 2004. VetPop uses the Census 2000 estimate of veterans—26,745,000 as of April, 2000—as a starting point.  The population increases as service members separate from active duty and decreases through mortality.  VetPop models these changes using DoD's reports of past and projected separations as well as DoD mortality rates.  VetPop2007 results are higher than VetPop2004 results due to lower mortality rates and higher-than-expected separations.  The difference is 1.2 percent in 2007 and grows to 2.8 percent by 2015. VetPop results can be accessed by visiting www.va.gov, selecting “Veteran Data” on the left side menu, then click on "Demographics."  The website includes estimates of veterans by county and by Congressional District, as well as descriptive documents and tutorials on how to access the data.  Further questions regarding VetPop should be emailed to VetPop@va.gov.

MOTHER'S DAY AT THE WALL From the NAUS Weekly Update May 2, 2008 - The Ninth Annual Mother's Day at The Wall Ceremony will be held on Sunday, May 11, at 9:00 a.m. at the Vietnam Veterans Memorial in Washington, D.C.  The Vietnam Veterans Memorial Fund (VVMF) will honor the Mothers of our service members by asking students throughout the United States to prepare Mother's Day cards to be read by Moms at the Vietnam Veterans Memorial on Mother's Day.  After reading the cards, the Mothers will lay the cards at its base of The Wall.  VVMF invites everyone to join them as they pay tribute to America's Mothers.  If you would like to send a card to be read by a Mom at The Wall, please send your cards to the VVMF at 1023 15th Street, N.W., Second Floor, Washington, DC 20005 by Wednesday, May 7.

VETERANS' AFFAIRS COMMITTEES VERY BUSY From NAUS Weekly Update for April 25, 2008 - This week both the House and Senate Veterans' Affairs Committees and several of their sub-committees were busy.  Thursday, the House Veterans' Affairs Subcommittee on Disability Assistance and Memorial Affairs approved draft legislation that advocates a broad overhaul of the VA disability claims system.  This unnumbered bill would change the way the VA assigns ratings to veterans, basing them on quality of life verses the current impact on loss of earnings capacity.  Also, and very importantly, it would require the VA to design a plan to modernize its claims filing system with new and improved information technology. Also on Thursday, the Senate passed H.R. 1315, which contains various measures to help veterans.  One of the provisions would provide benefits to Filipino veterans who fought along side U.S. forces in World War II.  Ranking member of the Senate Veterans' Affairs Committee Sen. Richard Burr (R-NC) offered an amendment, which was defeated, which would strip out benefits for those Filipino veterans that had not been injured in the line of duty.  The bill now goes back to the House where further attempts to change or eliminate this part of the bill are expected. Earlier in the week, the House Veterans' Affairs Subcommittee on Economic Opportunity favorably marked up several pieces of legislation that would improve the MGIB; direct a study to measure the effectiveness of VA's vocational rehabilitation program; improve VA home loan guarantees; move administrative authority for the Selective Reserve MGIB from DoD to the VA; improve the Special Adapted Housing program; limit housing foreclosures for service members returning from combat and allow VA to publicize benefits information in national media.

COAST GUARD AUTHORIZATION PASSES HOUSE From NAUS Weekly Update for April 25, 2008 - The House overwhelmingly passed the FY 2008 Coast Guard Reauthorization Act H.R. 2830, by a vote of 395-7.  The bill had previously elicited a veto threat from the White House due to the inclusion of a provision that would have required the Coast Guard to assess whether security at Liquid Natural Gas (LNG) sites was up to standards.  Several amendments to the bill modified the requirements which may overcome Administration objections.  Another provision of the bill will finally allow Coast Guard members to reside in the Armed Forces Retirement Home System.  Currently only Coast Guard members who served while the Coast Guard or individual units were under operational control of the U.S. Navy are allowed to participate.

EMERGENCY WAR SUPPLEMENTAL From NAUS Weekly Update for April 25, 2008 - Negotiations continued this week on what would be included in the funding requested by the President.  So far the bill will reportedly contain the $108 billion that the President requested to fund Afghan and Iraq operations for the remainder of FY 2008 and $70 billion for the first several months of FY 2009, which the President did not request.  As reported earlier, the majority leadership is considering adding domestic spending issues to the bill.  These include a limited extension of unemployment benefits, funding for wildfire firefighting efforts and aid for victims of Hurricane Katrina.  Additionally we learned this week that the leadership is considering putting in language to block new administration regulations that decrease Medicaid spending by $13 billion over the next five years.  This legislation was passed overwhelmingly in the House in separate legislation but faces a veto threat.  Funding for MGIB improvements may also be included.  On a positive note, the majority leadership says the Emergency Supplemental bill will not include any controversial war policy provisions as they are looking to avoid a veto.

DFAS REPORTS END IN SITE FOR BACK PAY From NAUS Weekly Update for April 25, 2008 - The Defense Finance and Accounting Service has reported that by May 31, it will complete its review of 133,000 files of disabled retirees who possibly were due back payments under two "concurrent receipt" programs which Congress approved in 2003 and 2004.So far, DFAS and the Department of Veterans Affairs have paid a combined $308 million in back payments to disabled military retirees.  The VA Retro Pay program was set up two years ago to calculate amounts mistakenly withheld from retirees as they began receiving either Combat-Related Special Compensation or Concurrent Retirement and Disability Pay.

DFAS says that 22,500 cases remain to be completed and retro payments calculated and paid.  They also report the number of contractors hired and trained to work the files has climbed to 233 from 51 since December.

MORE THAN 85,000 SERVE VETERANS AS VA VOLUNTEERS - As the nation prepares to mark National Volunteer Week, April 27 to May 3, officials at the Department of Veterans Affairs (VA) encourage more Americans to join the Department’s corps of 85,000 volunteers. (read more)

VA WANTS YOU: DEPARTMENT PUSHES TO HIRE VETERANS IN WORKFORCE From NGAUS Notes April 11, 2008 - The Department of Veterans Affairs, which has a distinguished history of hiring former military members, is stepping up efforts to recruit even more new veterans, especially recently disabled veterans into its workforce. Secretary of Veterans Affairs Dr. James B. Peake announced Thursday the creation of a Veterans Employment Coordination Service to oversee the department's recruitment of veterans.  "It is important VA continues to set the example to private and public employers," Peake said. "This program builds upon the department's long tradition of service to veterans, particularly the disabled." The new office will work with military transition programs, veteran service organizations and other VA programs to promote careers in the VA workforce. The program will also work with VA managers and human resources offices to ensure supervisors are aware of programs for hiring veterans. Efforts to assist severely injured veterans have already begun with the department's participation in career fairs targeting veterans of the global war on terror. In November 2007, VA announced plans to hire 10 full-time regional veterans employment coordinators who provide assistance to veterans interested in careers at the department. About 31 percent of VA's 260,000 employees are veterans and nearly 8 percent are service-connected disabled veterans. VA ranks first among non-defense agencies in the hiring of disabled veterans and is second only to the Defense Department in the overall number of veterans on the workforce.
